Warranty Terms & Conditions

Topware warrants that its products are free from defects in workmanship and materials for certain periods from the date of purchase. Subject to the conditions of the warranty, set out below, if the product fails or is otherwise found to be defective in materials or workmanship for any reason within the warranty period and the product is returned to the place of purchase, we will either repair or replace the product free of charge.

This warranty is for normal domestic and commercial use only and does not cover;

  • Defects and/or damage where adequate proof of purchase is unable to be provided.
  • Damage arising solely from the installation of Goods that are obviously defective at the time of installation (i.e. where they should not have been installed due to obvious defect)
  • Damage caused by accident, maltreatment, unusual stress or strain, harsh or adverse conditions, water pressure or temperatures that exceed stated limitations or that are generally excessive, neglect (including failure to follow recommended cleaning and maintenance instructions) or use of chemical cleaning products (including products containing high levels of chlorine) unless otherwise recommended.

AS/NZS3500 states that the maximum water supply pressure at any outlet within a building must not exceed 500kpa at any time. Where pressure exceeds 500kpa, pressure-limiting valves must be installed.

Maximum inlet water temperature not to exceed 50° C as required by AS/NZS3500

  • Damage caused by improper use, improper or poor installation.
  • Damage resulting from installation or repairs by an unlicensed plumber.
  • Failure to install Goods in accordance with Our instructions and specifications, public authority regulations or other National or State standards which govern water supply, sewerage and plumbing requirements of the location in which the Goods will be installed.
  • Damage to finishes by epoxies or adhesives or sealants.
  • Damages to finishes caused by impacts, external influences, incorrect installation or wrong treatment.
  • Defects or injury caused by or resulting from, the installation of the product into situations outside these conditions of the warranty.
  • The product has been tampered with in any way, or if any serial numbers, bar codes or other identification marks have been removed, defaced or changed.
  • Damage or loss to products caused during transit for service, where that transit has not been arranged by Topware.
  • Any defect or injury caused by an act, default or omission of, or any representation made by, any person other than Topware or an employee or agent of Topware.

Consequential Loss

Subject always to rights You have under the Australian Consumer Law, and to the extent otherwise permitted by law, we will not be liable for any loss or damage to floor coverings, walls, fixtures, furnishings, or any other consequential loss caused by a defect in the Goods. For the avoidance of doubt, the exclusion of consequential loss applies only to loss occurred outside of the guarantees provided by the terms of the Australian Consumer Law.

How to make a warranty claim?

  • Make sure you`ve read the terms of the Topware warranty;
  • contact us at sales@topware.au with your proof of purchase and a description of the problem. Provide all known relevant details of the model, finish and nature of the problem to assist with the identification and rectification of any fault;

A service fee may also be charged where We or Our agent attend an agreed appointment time with You for inspection or repair but You do not attend.

Costs

Topware will bear any expenses incurred for claims under this warranty, excluding;

  • Any costs incurred by a Topware Agent or their nominated Service Agent (including the cost of any service call) due to you incorrectly identifying the product or nature of the problem or being absent for a mutually agreed appointment.
  • Any and all travel costs and expenses incurred or charged by Topware or their nominated Service Agent in connection with any inspection of the product outside metropolitan areas or outside the normal operating areas of Topware.

Any claim for expenses incurred in making a claim under this warranty should be sent to Agent in writing at the address below.
